Terms & Conditions

T&C’s – Instagram Giveaway Terms and Conditions

1. Eligibility: This giveaway is open to residents of Australia, excluding the Australian Capital Territory (ACT), aged 18 years and over. Entrants under the age of 18 must be accompanied by a guardian, whose flight and transfer expenses will be covered by the Pho3nix Foundation.
2. Additional Guest: If the participant is of legal age, being 18 years or older, they may invite a maximum of one other person to accompany them. However, this prize is limited to one person participating in the swim session and one twin share room. The Pho3nix Foundation will only cover the cost of the flights for the additional person. All other expenses for the companion will be borne solely by them and not by the Pho3nix Foundation.
3. Giveaway Hosts: The giveaway is facilitated by the Pho3nix Foundation in partnership with Swimming Australia.
4. Prize Period: The dates of the prize will be determined by the Pho3nix Foundation and Swimming Australia based on the availability of the Australian Dolphin.
5. Training Session: The selection of the Australian Dolphin for the training session is contingent upon availability and will be arranged in collaboration with Swimming Australia.
6. Prize Details: The prize includes an opportunity to attend a training session with an Australian Dolphin, along with coverage of the following expenses: hotel accommodation, flights, transfers to and from the airport, and transportation to and from the training session. Any additional expenses are to be covered by the winner. This prize is not transferable and cannot be exchanged for a cash valuation.
7. Entry: To enter the giveaway, participants must follow the Instagram accounts of the Pho3nix Foundation and Swimming Australia, like and comment on the giveaway post.
8. Winner Selection: The winner will be selected at random from all eligible entries received during the giveaway period. The selection will be conducted by representatives of the Pho3nix Foundation and Swimming Australia.
9. Winner Notification: The winner will be notified via direct message on Instagram within seven days of the giveaway closing. The winner must respond to the notification within 48 hours to claim the prize. Failure to do so may result in disqualification and selection of an alternate winner.
10. Permission to Shoot: By participating in the giveaway, entrants grant permission to the Pho3nix Foundation and Swimming Australia to shoot the training session with the Australian Dolphin, and to use any resulting content for promotional purposes on their respective social media channels and other platforms.
11. General Terms: This giveaway is subject to Instagram’s terms of use. It is in no way sponsored, endorsed, or administered by, or associated with, Instagram or Meta. Participants release Instagram from any and all liability related to this giveaway. The Pho3nix Foundation and Swimming Australia reserve the right to cancel, suspend, or modify the giveaway if any fraud, technical failures, or any other factor beyond their reasonable control impairs the integrity or proper functioning of the giveaway.
12. Disputes: Any disputes arising in connection with this giveaway shall be governed by the laws of Australia and shall be subject to the exclusive jurisdiction of the courts of Australia.
13. Privacy: Personal information provided by entrants may be used by the Pho3nix Foundation and Swimming Australia for the purpose of conducting the giveaway and for related promotional activities. Personal information will otherwise be handled in accordance with the Pho3nix Foundation’s and Swimming Australia’s respective privacy policies.
14. Winner Announcement: The name of the winner will be announced on the Instagram accounts of the Pho3nix Foundation and Swimming Australia within seven days of the winner claiming the prize.
